§ 74-59. Spitting on law officers.

  • (a)

    It shall be unlawful for any person to intentionally spit or emit saliva or other fluids upon the person of a law officer.

    (b)

    For the purpose of this section, the term "law officer" shall include commissioned police officers, sheriffs, marshals, correctional officers and constables.

    (c)

    Whoever commits the offense of spitting on a law officer shall be fined not more than $500.00 and imprisoned for not less than five days nor more than 60 days without benefit of suspension of sentence.
